«Liability» in the legal sense is the responsibility for damage. Liability is to be distinguished from warranty or guarantee, i.e. having to take responsibility for a defect in relation to a product (good or service). In Switzerland there is a fundamental difference between contractual (Art. 97 ff. of the Swiss Code of Obligations, CO) and non-contractual liability (CO 41 ff.). There is also tort or fault-based or tort and strict liability.
